HC seeks property details of I&FC officers, spouse | | | Early Times Report
Srinagar, Nov 24 : The J&K high court today directed all Irrigation and Flood Control Department officers' responsible for maintenance for Padshahi canal to furnish property details as well as the details about their spouse and children. The directions were issued by a division bench comprising Justice Muzaffar Hussain Attar and Justice Ali Mohammad Magrey hearing a Public Interest Litigation, seeking restoration of Padshahi canal in Ganderbal district of central Kashmir. In this regard, the court directed its registry to issue notice to all the officers whose list was furnished by the Chief Engineer I&FC, asking them to explain as to why action in accordance with law should not be initiated against them for alleged dereliction of duty. "These officers shall also disclose to the court, by filing an affidavit, as to how much movable or immovable property stands in their names or in the names of their spouse and dependent children." They shall also disclose, court said, as to how much money was in their Bank Accounts along with particulars of the Banks. "These officers, whether in service or retired, shall file the affidavit before the next date of hearing." In its order on August 14, the court had taken prima facie view that without connivance of the officers encroachments would not take place. "It (was) in that backdrop that we have issued notices to all those officers whose list has been provided by the Chief Engineer before the Court," the court said. The court also directed the Chief Engineer and other statutory authorities that they would be personally responsible to restore the canal to its original width along its entire course. "The Chief Engineer and other authorities, in order to accomplish the purpose, would be at liberty to seek police assistance," the court said and directed the Inspector General of Police, Kashmir, to provide necessary police assistance to the authorities as and when they made the requests. The court also directed the authorities to enforce laws to remove all the encroachments along the course of river Jhelum. "The laws have to be enforced with all their vigour and force. Few individual's greed cannot be permitted to play havoc with the rights of the millions of people of the Valley," the bench said and directed the Chief Engineer to file the compliance report about removal of the encroachments before the next date on December 15. |
