DB directs IGP to explain why traffic congestions could not be controlled
PIL regarding parking, security, lawyers' chambers

Jammu, Nov 24 : In a Public Interest Litigation (PIL) filed by Bar Association Jammu and SumitNayyar seeking various development activities around court complex including parking, new road, health center and security of the Advocates, Judges and Litigants, Division Bench of High Court comprising Chief Justice MM Kumar and Justice TashiRabstan after hearing Sr. Adv MK Bhardwaj and AdvVeenu Gupta for the PIL whereas Sr. AAG GaganBasotra for the state and Sr. Adv AV Gupta with AdvAditya Gupta for the other respondent, observed that With regard to the traffic congestions, "we reiterate our directions issued on March 6, 2014 and directed I.G.P to come forward to explain as to why the traffic congestions could not be controlled. There are long queues of traffic which are stated to be seen by the counsel and sometimes one is in queue for ours together. A status report be filed before the next date."
Division Bench further observed that Sr. Advocate AV Gupta stated that the visit to the site has been undertaken and the written suggestions shall be made. In respect of funds which are to be released, Sr. AAG GaganBasotra, stated that an affidavit shall be filed within a week. Division Bench further observed that in respect of acute problem of parking of vehicles by the members of the Bar and others, the State government has filed a status report dated 21.10.2014 wherein a reference has been made to the directions issued by this Court for expansion of the parking area which resulted in survey of the proposed parking area. Accordingly, a site plan of the proposed parking in the High Court Complex, Jammu and the estimated cost has been put forward. An affidavit in support of the aforesaid report has been filed by the Executive Engineer, PWD (R&B), Construction Div. No.II, Jammu. According to the estimate, the construction of proposed parking at the High Court Complex, Janipur, Jammu is to be undertaken into two phases. The first phase is with regard to earth work which includes laying of WBM Gr-II and Gr-III and then construction of pucca retaining wall. The total costs reflected for the first phase is Rs.110.69 lacs. The second phase involves macadamization and electrification etc., which involves expenses of Rs. 171.14 lacs.
Upon this Sr. Adv MK Bhardwaj and the President of the Bar has stated that the aforesaid proposal for expansion of parking in the High Court Complex is feasible and acceptable to the Bar. According to the counsel, the area was inspected by a Committee which comprised of two Judges also.
Division Bench directed respondents to finalize the expansion of parking as per the proposal made in the status report dated 21.10.2014 and reflected and all steps leading to the finalization of the project be taken at the earliest and the project be executed without further waste of time, preferably within a period of six months. A status report with regard to formulation of the project be filed before the next date of hearing.(JNF)
