Govt departments violate labour laws with impunity | JKSERC seeks security guards for 12 hour duty | | Akshay Azad Early Times Report JAMMU, Jan 1: Apart from private institutions the government institutions are also found flouting the labour laws with impunity in terms of duty hours and in one such case Jammu and Kashmir State Electricity Regulatory Commission (JKSERC) had wanted to engage security guards with 12 hour duty, instead of eight hours as permissible under laws of land. According to the tender notice number JKSERC/02 of 2014, Secretary of Commission has invited tenders from registered security agencies, engaged in providing of skilled/ unskilled manpower for services of security guard in the J&KSERC at Ambedkar Chowk Jammu from Ist February 2015 to 2016. One line in the tender notice read as "The duty hours for such personnel (security guard) shall be 12 hours a day", which is violation of labour laws. Surprisingly, the same tender notice was also published one week back and was republished today but instead of rectifying their error, the JKSERC authorities, least bother about it. Sources in J&K Labour and Employment Department informed Early Times that no law permitted to any government, semi government or private agency to engage workers for duty of 12 hours a day. "The average working hours for each worker is eight hours a day besides some extra time permissible under some circumstances but that too only for few days in a month", they said, adding that engaging workers for 12 hours a day was against law. Sources regretted that on one hand, already most of registered security agencies have been paying meager salary to the security guards but on the other it was very unfortunate on part of JKSERC which was a government agency and has been caught violating labour laws. Assistant Labour Commissioner Jammu, Ashok Choudhary said that no labour law has been permitting anyone for engaging any worker for 12 hours a day. He further said that the security guards were engaged in various establishments including Banks, Hospitals by the Principal employers (Banks, Hospital administration), after entering into a contract with Security Agency. "Principally the Principal employer should be held responsible for providing all benefits to labourers but unfortunately same has not been done", he said, adding that he would soon take cognizance of matter and take appropriate action. Secretary of JKSERC Abdul Hamid said that after going through the notice, he would rethink and took appropriate action. |
