To appease Minister, deptt likely to dump SC's decision on seniority | FPF awaits recruitment rules since its creation in 1996 | | Akshay Azad

Jammu, Nov 12: The recruitment rules for Forest Protection Force (FPF) are under process and employees are quite apprehensive that the department is likely to sideline decision of Standing Committee on finalization of seniority list. Sources informed Early Times that a five member standing committee had its meeting on 21/8/2014, to discuss the finalization of Recruitment rules of FPF, which have yet to frame since the creation of Force way back in 1996. The five member Standing Committee was comprised of Administrative Officer of FPF, Director Codes of Finance Department, Special Secretary (Technical) Forest department, Special Secretary Law, Commissioner Secretary of Department of ARI and Trainings. "During the meeting it was finalized that the seniority of the members of FPF would be determined on the basis of rule 24 of CCA rules of 1956, according to which seniority of officers, would be decided as per the merit of the employees in the selection list", sources said. They informed that Commissioner Secretary Forest Department in a contempt writ title Siraj-ud-din and others v/s State had agreed before that court on 21/10/2016 at Srinagar that they would notify the recruitment rules of FPF within two months. "Surprisingly, the department has not implemented their own decision regarding the fixation of seniority of members of the Force and there is every possibility that to appease the Minister concerned the department would sideline the Standing Committee decision", sources said. They further informed that a lot of litigations were pending in High Court due to non-implementation of decision. "Further Director FPF had also moved a proposal for amending in Rule-38 of SRO 264 and its replacement with rule 24 of CCA rules of 1956 due to various flaws in rule 38 of SRO 264", sources said, adding that Rule-38 of SRO-264, which envisaged that seniority of members would be determined on the basis of merit obtained by the members of department in the examination held at the time of training course and the Minister of Forest was reportedly in favour of implementing that flawed rule for the reasons best known to him. Sources added that prior to SRO-264 there was no litigation pending in the department regarding the seniority issue and after its introduction more than a dozen writ petitions were pending in court. "The Rule-38 has following flaws such as for some official of FPF the initial training is Forestry training while for some other it is weapon training. Persons joining the department on the date have been deputed for training in multiple batches. Significant number of officials have still been not imparted any training. No instructions were passed on the members of department before any training that merit obtained in the training would decide the seniority. No sanction was granted by the Forest administrative department for imparting weapons training to officials of FPF", sources said, adding that keeping in view such flaws in rule-38 of SRO-264, Director FPF had move a proposal for replacement of Rule 38 of SRO 264 with Rule 24 of CCA rules of 1956. Moreover, in the meeting of standing Committee for finalization of Recruitment Rules of FPF on 21/8/2016 where it was decided finally to replace Rule-38 but till date necessary amendments have not been made, for the reasons best known to authorities. "The Minister for Forest is reportedly in favour of Rule-38 of SRO-264 and to remain in good books of Minister the officials have shying away from implementing the decision of standing committee", sources alleged. |
