Jammu, Nov 12: Two walnut kernel traders have been booked by the crime branch of police for allegedly making double insurance claim in a 'stage-managed' truck accident at Chenani near Udhampur in November last year.
A private investigating agency had lodged a complaint with CB, alleging therein that while investigating the cases entrusted to it by M/s HDFC ERGO General Insurance Company Ltd, Delhi, regarding insurance claim No C241215013860 under policy No 2412201221091700000 of Wani Enterprises, Sallar, Anantnag owned by Rafi Ahmed Wani and M/s Tata AIG General Insurance Company Ltd regarding insurance claim No 895361 under policy No 0840015366 of Wani International Walnut Industry owned by Shakeel-ur-Rehman Wani with respect to the damage to stocks of walnut kernels due to a road accident at Chenani on November 27, 2015, a case of double insurance claim was detected.
While making the insurance claim, the party had concealed the material facts. It was alleged that Wani Enterprises had got the consignment insured with M/s HDFC ERGO General Insurance Company Ltd vide policy No 2412201221091700000 for 14,145 kilograms of walnut kernels with a declared value of Rs 1,81,69,745 in the name of Wani Enterprises Sallar, Srigifwara, Anantnag. The consignment was dispatched through Jehlum Roadlines Pvt Ltd to M/s S K Traders, Mumbai, whereas the same consignment was also got insured through M/s TATA AIG general Insurance Company Ltd with a declared value of 1,81,69,745 in the name of Wani International Walnut Industry, SIDCO Complex Shalteng Industrial Estate, Srinagar. The consignment was again dispatched through Jehlum Roadlines Pvt Ltd to M/s S K Traders, Mumbai.
However, after the alleged accident on November 27, 2015, the truck (JK03B/9156) at Chenani, separate claims were made before HDFC ERGO and TATA AIG for an amount of Rs 3.62 cr on account of loss of the consignment whereas on physical verification and investigations by the company surveyors only about 1,790 kg walnut kernels were found from the alleged spot without any reasonable evidence of an accident and it was found that the vehicle was deliberately pushed with a criminal intention to defraud two insurance companies and seek compensation amounting to crores of rupees.
The CB probe revealed that accused proprietors Rafi Ahmed Wani and Shakeel-ur-Rehman Wani, in furtherance of a criminal conspiracy, got a fraudulent consignment of 14,145 kgs of walnut kernels insured through two different insurance companies separately under different proprietorship and thereafter, under a well-planned strategy, created and conducted an accident at Chenani.
The CB has booked the two accused under sections 420, 465, 466, 467, 468, 471 and 120-B of RPC. (JNF)
