| HC calls for personal appearance of ACR Kishtwar | | De-notification of land for GDC | | Early Times Report
Srinagar, July 23: The High Court of Jammu and Kashmir today called for the personal appearance of the collector land Acquisition( Assistant Commissioner Revenue) Kishtwar in a writ petition filed by the residents / inhabitants of Shahidi Mohalla Kishtwar in a case regarding de-notification of the 8 land Marlas of land, nearly two decades after acquiring it for the college development purpose despite of the fact that Principal of Government Degree College Kishtwar objected the move of the former ACR Kishtwar.
As per the details available with Early Times, Justice Janak Raj Kotwal after hearing advocate N.D Qazi; counsel for the petitioner stayed the operation of the order dated 10-4-2018 whereby the Collector, land acquisition (ACR) Kishtwar de-notified 8 marlas of land earlier acquired for construction of government degree College Kishtwar.
Counsel of the petitioner stated that that no such power is conferred to the collector under sub section (i) of the state land acquisition Act. The court after hearing advocate N.D Qazi called for his personal appearance on the next date of hearing along with the beneficiary on whose name the said piece of land has been de-notified.
It is pertinent to mention that the said piece of land has inadvertently left outside the boundary wall of the college by the contractor and despite the fact that college management has proposed to construct the college guest house and official quarters, but the said ACR Kishtwar on the direction of some seniors revenue officers acted beyond his jurisdiction and de-notified the said piece of land that too without going into bidding process.
Sources informed that there is huge encroachment on the college land, but due to political intervention from time to time, the successive District Administration's fails to retrieve the encroached College land worth Crores of rupees. |
