ULB ignores Govt guidelines, pays Rs 19 lakhs excess to Counsels

Jammu, July 23: The Department of Urban Local Bodies has reportedly made payment of Rs 19 lakh in excess to its Standing Counsels engaged for defending its cases in various courts ostensibly ignoring the rates fixed by the Government.
Sources told Early Times that Urban Local Body had engaged seven Standing Counsels/ Senior Standing Counsels for defending its cases in various Courts. Against the admissible amount of Rs 3000 per month fixed by the Government, the monthly retainer-ship was paid to seven Standing Counsels at rates ranging between Rs 10,000 and Rs 18,000 resulting in excess payment of Rs 18 lakh.
"Moreover, one Standing Counsel was paid Rs 76000/- as counsel fee and final disposal fee against admissible amount Rs2000 resulting in excess payment of Rs 74000/-," they informed further adding that although the department claimed that the amount paid was as per fee structure fixed by the General Function Committee of the Corporation but the fact of the matter is that the excess payment was unjustifiable as Standing Counsels deputed by the Government were entitled to fee/ retainer-ship/ other charges in accordance with the free structure fixed by the Government.
They further informed that similarly the Advocate General who is the Chief Law officer of the State appointed under the Constitution of Jammu and Kashmir and is entitled to a fee of Rs 4000 per effective hearing before the Supreme Court and a sum of Rs 1000 for each day of travelling in addition to monthly remuneration payable by the Government. "The Advocate General was paid and amount of Rs 5.50 lakh for five effective hearings against admissible amount of Rs 25000 which resulted in excess payment of Rs 5.25 lakh. It has been learnt that payment was by the corporation's discretion but factually the Advocate General is also entitled to counsel fee/payments as fixed by the Government," they said.
