Backdoor appointment of KAS officer: GAD refuses to give details under RTI

Jammu, June 13: At a time when Governor and Chief Secretary have assured to launch an offensive on corrupt officers and their corrupt practices plus exposing backdoor appointments in J&K Bank, the General Administration Department (GAD) on the other hand has withheld information pertaining to a backdoor appointee who presently works as a senior KAS officer and heads a very important organization.
The officer is said to have been appointed as a Gazetted Officer (Assistant Director) through backdoor means way back in 1997-1998 during National Conference government. The officer, after some years, was inducted into KAS cadre and presently works in the Special Secretary grade.
As reported already from 1996 on-wards several backdoor appointments have been allegedly made in many Government departments and it is not only JK Bank where these appointments have been taking place through illegal means. Organisations like Srinagar Municipal Corporation, SKIMS, Kashmir University, SKUAST (K) and (J) and Directorate of Urban Local Bodies Jammu/Kashmir are the main organizations where illegal and backdoor appointments have taken place in past.
In many government department like Hospitality & Protocol (H&P) sources say that some gazetted and non-gazetted officers were also appointed illegally, some of whom are now posted at very senior level. These officials got inducted into KAS several years back. The details have already been sought under RTI Act and Early Times had filed a detailed report on the same.
When further information was sought from GAD under RTI by an information seeker about the name and designation of public functionaries who had recommended these appointments plus copy of entire file notings, GAD sat on the RTI application. Some weeks back information seeker filed 1st appeal before the Additional Secretary of GAD who is First Appellate Authority (FAA) under JK RTI Act 2009 in GAD. The officer has not disposed off the case or heard the appellant.
With an aim of getting exact details of some backdoor appointees an information seeker had filed an application under JK RTI Act 2009 in the office Chief Secretary (CS) J&K. The CS office forwarded the application to Hospitality and Protocol Department and General Administration Department (GAD) in past. In that case information was provided like appointment orders etc.
Vide his RTI reply No: DDH&P / Estt/ 677-79 Dated 11.03.2019 the Assistant Director Hospitality & Protocol (H&P) Department who is also the designated Public Information Officer (PIO) in the said directorate had said that none of the employees were appointed between 1996 and 2002. When copies of appointment orders were sought , the PIO again was reluctant to provide the same. When the RTI applicant sought details of appointments made without recommendation of JK PSC or SSRB , the PIO in his reply said " Not Applicable". But after filing of 1st appeal in GAD the information was provided. But when a fresh RTI was filed few months back , the details are not being provided by GAD alleges information seeker (name withheld) . Information seeker has appealed Chief Secretary and State Information Commission to take action against PIO of Hospitality and Protocol Department who had provided misleading information that no appointment in gazette cadre were made between 1996 to 2002.
