HC stays 'illegal' transfer order of law officer
Deptt still favours Urdu Coordination wing employee

Jammu, June 12: The J&K High Court has stayed the transfer of a law officer who was replaced allegedly by an influential assistant draftsman of the Urdu Coordination wing.
The law department is reportedly, however, still adamant on favouring the Urdu Coordination employee and has not relieved him despite the court orders.
Early Times has been highlighting the issue of illegal transfer orders issued by the law department, which had adjusted the assistant draftsman of the Urdu section on the post of law officer.
Despite repeated appeals by the law officer to minister concerned and law secretary for arresting the practice of appointing assistant draftsmen against law officers posts', an aggrieved law officer, who was transferred twice in less than a month, knocked the door of High Court and got stay over his transfer.
Altaf Ahmed was transferred from Health department to R&B department on May 12. After he joined the R&B department on June 5, he was transferred again to Industries and Commerce department.
Assistant draftsman of Urdu Coordination Manzoor Ahmed Lone, who was working on the post of law officer in R&B department, was transferred to Industries and Commerce department on May 12. But on verbal orders of Commissioner Secretary, Lone was also allowed to continue in R&B department, where Altaf was continuing.
A High Court bench of Justice Ali Mohammad Magray on June 9 stayed the order by virtue of which Altaf was transferred from R&B to Industries and Commerce department.
The bench also directed Commissioner Secretary to government R&B department to allow Altaf to continue to discharge his duties in the department and relieve respondent Lone forthwith.
Taking serious note of the transfer orders, the HC has also asked Law Secretary and Commissioner Secretary to explain under which authority they posted Lone in the Industries and Commerce department as assistant draftsman and work in R&B when there was no such post available in the said department as the post of assistant draftsman is available in Urdu Coordination cell only.
"Transfers have been held to be the exigencies of service and least interfered by the court of law. However the executive cannot be left so free to even merge two different service classes together as that would result in chaos," the court observed.
Though the court has stayed the transfer order of the law officer, sources in Civil Secretariat informed Early Times that the assistant draftsman was refusing to leave the office of law officer.
"Instead of rectifying the system, the new law minister is shielding the corrupt officers who are running the lucrative transfer industry," said a Secretariat employee, pleading anonymity.
