| Anti corruption Court discharges Tehsildar, Girdawar, two Patwaris | | | Jammu, Apr 7 (JNF): Additional Sessions Judge Anti corruption Jammu Sanjay Parihar discharged corruption charges against four persons including Tehsildar, Girdawar and two Patwaris and remitted the case to Chief Judicial Magistrate (CJM) Jammu for further proceedings against three persons.
After hearing Advocate S M Choudhary appearing for the Revenue Officials, Additional Sessions Judge Anti corruption Jammu observed that in absence of any overt or quid-pro between these revenue officials and private parties, it is difficult to believe that revenue officials might have committed any dishonest act with reference to land in question and appeared that no material on police file to lay presumption that revenue officials had recorded the entry on the aid land with dishonest intention or with any monetary gains. With these observations, the Court discharged Revenue officials namely identified as Mohd Shafi S/o Subhan Din Naik the then Patwari Bandobast Halqa Dharmal (now retired), Prabu Lal Parihar S/o Karam Chand R/o Paloura Top, Jammu, the then Patwari (now retired), Ram Dass the then Girdawar, Dharmal Muthi (now retired) and Pritam Dass the then Naib Tehsildar Muthi (now retired) at the stage of framing charges and remitted the case to CJM Jammu for further proceedings against Rattan Lal S/o Garib Dass R/o Udhay Wala, Jammu, Sanjay Raina S/o Rajinder Kumar R/o Lower Muthi, Jammu and Joginder Singh S/o Mansha Singh R/o Pacci Dhakki, Jammu.
According to the challan produced by Crime Branch Jammu on December 31, 2013 that complainant Neelam Kumari W/o Krishan Lal Pandoh R/o Talab Tillo, Jammu in her complaint, to Inspector General of Police (IGP), Crime and Railways J&K Jammu, alleged that she has been in possession of land measuring 2 Kanals and 10 Marlas falling under Khasra No 257, situated at Muthi Dharmal Tehsil and Distt Jammu which was mutated on her name vide Mutation No 544 in the year 1992.
She further alleged that in the year 2002, when she was approached by Rattan Lal and Sanjay Raina for sale of the land in question, she did not know that she stood deprived of her legal rights in respect of her land in the revenue records by the land grabbers in connivance with revenue officials. The land grabbers had hatched a criminal conspiracy with the Revenue authorities and had tempered, fabricated and manipulated the revenue records, whereby the land of the complainant was shown in the revenue records as that of Madan Lal, and others. She also had alleged that later Sanjay Raina prepared a fake agreement to sell in the year 2004 pertaining to the said land in question after putting her fake and fictitious signatures on the said agreement deed. The accused persons with the connivance / conspiracy of concerned revenue officials have fraudulently manipulated the records and prepared the fake documents by way of impersonation and the complainant has been deprived of her landed property. On this the instant case was registered. During the course of investigations, all the relevant revenue records of the land in question including fake agreement to sell was obtained and seized. Besides, a Cheque bearing No. 1604952 for Rs. 2,13,000/- issued by the accused Sanjay Raina was also seized from the complainant which had got bounced from the bank due to insufficient funds.
