Cop booked for damaging Quran acquitted as holy book found intact | | | Jammu, July 21 : Principal Sessions Judge, Poonch, Jaffer Hussain Beigh today acquitted Nazir Ahmed Bhat of Pathan, Pulwama, who at present is posted in Armed Police 6th Battalion and was alleged to be involved in causing damage to Quran, as the holy book was found intact. According to the police case, on August 20, 2011, the accused with criminal intention tore the pages of Holy Quran which annoyed the sentiments of Muslim Community and in order to save himself from the punishment, destroyed the said pages. Charges for commission of offence u/Ss 295,201 RPC were framed against the accused on 11.3.2013. The judge, after hearing both the sides, observed that there is no material on record to show which pages were removed by the accused from the Holy Quran because the copy of the holy book seized by police in the instant case is complete in every respect and not a single page of it has been shown to have been destroyed. When the Holy Quran is complete in all respects, it cannot be said that any page of it was damaged by the accused. Not to speak of the contents of the Holy Quran but the starting pages containing the other materials in the said copy of the Holy Quran are not shown to have been damaged or cut out from the Holy Quran. In view of these facts it is very difficult to agree with the prosecution that the accused in any way destroyed, damaged or defiled any page of the Holy Quran, so the question of insulting the same also does not arise. With these observations, the court held that the challan of the prosecution is dismissed and the accused is acquitted of the charges framed against him. He shall stand released from his bail bonds. The copy of Holy Quran seized in the instant case shall be handed over to the concerned Incharge Mosque from which it was seized, he ordered. |
