Bhim makes a right noise, demands Governor’s rule
Time for rehabilitation, not for Assembly polls

JAMMU, Sept 12: Expressing anguish, shock and dismay over the situation that has arisen in Jammu & Kashmir following heavy and incessant rains and flash floods on an unprecedented scale and the havoc and destruction caused by the natural calamity both in Jammu Pradesh and Kashmir Valley, Jammu & Kashmir National Panthers Party (JKNPP) chief patron Bhim Singh has urged Governor NN Vohra to invoke section 92 of the Jammu & Kashmir Constitution and take the administration into his own hands. Actually, he referred to the resolution the working committee of the JKNPP that was adopted on the emerging situation in the state and sought the Governor's intervention, as, according to his party, there exists no government worth its name in the flood-ravaged Jammu & Kashmir.
"Governor NN Vohra (should) invoke section 92 of the Jammu & Kashmir Constitution through a proclamation to assume to himself all the functions of the government of the state as well as all the powers vested in or exercisable by the Council of Ministers…The Working Committee of the JKNPP feels that the present government headed by Omar Abdullah has ceased to function and discharge its duties and, therefore, there is a need to invoke section 92 immediately…The President of India, Pranab Mukherjee to grant his concurrence for the Governor's Rule in the state," the resolution, as per Bhim Singh, said.
Not just this. Bhim Singh has also urged Governor Vohra to open Governor's Relief Fund so that all donors may contribute directly to the said Fund and added that the all the rescue and relief work should be done under the supervision of the State Governor. Interestingly, elements in Kashmir have demanded recall of Governor Vohra, saying "he is an old man". The state needs a young Governor, who can work," they have said. They were highly critical of Governor Vohra. However, they share the view that the relief and rehabilitation work should be in the hands of New Delhi. They say they have no faith in this government and that it is their fear that corrupt and insensitive elements in the establishment and ruling elite would misappropriate the funds meant for relief and rehabilitation purpose.
Jammu & Kashmir is the only state in the country which can be kept under the Governor rule for a maximum period of six months. The Governor can bring the state under his direct control in case he feels satisfied that the constitutional machinery in the state has broken down and the state government is just incompetent to handle the administration and discharge its obligations towards the people and the state. It has happened in the state a number of times in the past.
The view of the JKNPP that the Omar Abdullah-led NC-Congress coalition government should be dismissed forthwith and the state be brought under the Governor Rule has many takers in the state. The affected people have no love lost for the Omar Abdullah government. They consider it highly corrupt, arrogant, irresponsible and incompetent. Ask any affected person in the Kashmir Valley about the nature of the present regime, his/her answer would be: Down with this government, as it has failed the people of the state. The response of the people in Jammu province is also the same. The fact of the matter is that the people of the state hate this government and want a dispensation that is people-friendly, compassionate, democratic and honest. Their hostile attitude towards the state government is the consequence of the manner in which it handled the state before and after the September floods, which left lakhs and lakhs of people in distress, with the administration nowhere in sight.
Another view that has attracted the attention of the people is the view that the coming assembly elections in the state be deferred, as the time is not opportune for any electoral exercise. This is a valid view. Lakhs of people in the state have lost everything.
They have lost their houses, shops and small agricultural fields. Almost three-fourth of the Valley needs to be rebuilt afresh. Such has been the impact of the rains and floods on Kashmir.
The plain areas of Jammu province and many areas in Poonch, Rajouri, Doda, Kishtwar, Ramban, Reasi, Udhampur and Kathua districts have also suffered huge losses. The truth is that the floods have destroyed and disturbed everything. They are right when they say that it's time for relief and rehabilitation and not for elections.
The Election Commission of India needs to consider this view dispassionately and delay elections by about six months.
It would be injustice to the people if the assembly polls are held this year. Of course, Omar Abdullah and his ilk would insist on assembly elections this year because if elections are postponed he would not be in the driver's seat after January 4, 2015. But he cannot dictate terms to the ECI. The situation in the state is extraordinary. The ECI has to adopt a holistic view. One can only hope and pray that good sense would prevail and the ECI would measure up to the expectation.
