JAMMU, Nov 15: Senior Congress leader and former Minance Minister P Chidambaram, who refused to contest the last Lok Sabha election fearing a humiliating defeat, on Friday made a ridiculous statement that was aimed at demoralizing our soldiers involved in anti-insurgency operations and according a dangerous legitimacy to the dangerous demand of the Kashmiri separatists and outgoing Chief Minister and NC working president Omar Abdullah that seeks revocation of the Armed Forces Special Powers Act (AFSPA). Under the AFSPA, the soldiers involved in anti-insurgency operations in Kashmir and other parts of the country enjoy legal immunity, which is imperative.
Chidambaram, who is known for making highly inflammatory statements, on Friday condemned the AFSPA and dismissed it as an obnoxious legislation. "AFSPA is an obnoxious law that has no place in a modern, civilized country. It purports to incorporate the principle of immunity against prosecution without previous sanction. In reality, it allows the Armed Forces and the Central Armed Police Forces (CAPF) to act with impunity," Chidambaram said in a statement in New Delhi. "In 2010 the Home Ministry had initiated the process of repealing, or at least amending, AFSPA. Amendments were proposed to Section 4(a) which allows the use of force even to the causing of death. Amendments were also proposed to the sections that permitted search or arrest without warrant in all circumstances. The draft amendments were stoutly resisted by the Armed Forces and the Ministry of Defence and it remains an unfinished business," he also said.
Irresponsible Chidambaram nowhere in his lengthy statement referred to the circumstances under which the AFSPA was enforced in the state. Nor did he say that the state government was a party to the enforcement of this legislation in the state. Had the state government not invoked the Disturbed Areas Act, no one would have enforced the AFSPA.
On the contrary, he swung solidly behind Omar Abdullah, who only the other day stated that Chidambaram wanted to revoke or amend the AFSPA, but could succeed because the UPA Government buckled under the BJP pressure.
It was not the first occasion when Chidambaram made such an irresponsible statement. In October 2009, he had gone to the extent of saying that "Kashmir has a unique history and unique geography and that solutions which are applicable to other states of the Union cannot be replicated in Kashmir".
In other words, he had sought to create an impression that Kashmir was not really an integral part of the country.
Chidambaram would do well to hold himself aloof from the affairs of Jammu & Kashmir. For, the people of the state do not want such irresponsible persons to poke their nose in the affairs of the state. His statements only outrage the nationalist constituency in the state.
