Registration of transport agencies denied to women
Commercial Taxes deptt accused of gender bias

Jammu, Nov 15: The Commercial Taxes department has different yardsticks for men and women. While males get the registration of transport agencies, women are denied this right.
According to circular number 3/Reader/VAT/103-59/CCT dated 9/4/2014, issued by Department of Commercial Taxes, it has been explicitly mentioned that no fresh registration of Transport agency, should be granted, more particularly where proprietor/owner was a female, without prior approval of the Commissioner Commercial Taxes.
The circular further read as, "The Deputy Commissioner Commercial Taxes (V&I) Jammu/Srinagar are sanitize to monitor the conduct of transport agencies and should ensure that their staff posted in different areas more particularly where majority of transport agencies have their godown, monitor the conduct of transport agency".
The circular further mentioned that Additional Commissioner Commercial Tax (Administration) Jammu/Srinagar would kindly review and examine the certificates of registration issued to different transport agency. "No fresh registration should be granted, more particularly where proprietor/owner is a female, without prior approval of the Commissioner Commercial Taxes", the circular read.
It further read as, "All applications for grant of registration either as a dealer or as a transporter are necessarily be referred to Commissioner Commercial Taxes by the concerned authorities where proprietor/owner is a female".
The concluding paragraph of order mentioned, "We have witnessed difficulties in recovery of arrears against the firms where the owner/proprietor is a female, hence more security need to be obtained from the firm which is being obtained by a firm having its proprietor/owner as a female."
"This circular issued by department is totally arbitrary and dictatorial and the rationale behind it is far from imagination", said an advocate of J&K High Court, adding that on one hand entire country has been witnessing voices for empowerment of woman, who have also taken strides in every sphere of life including business but the circular of Commercial Taxes department showed patriarchal mindset of officials.
"We have judiciary, police and enforcement wing of department itself and as per our opinion the recovery from women is easy than man as she could not flee her home", he said, adding that the increase in security limit from female, was the way to restrict woman from becoming an entrepreneur.
Commissioner of Commercial Taxes department was not available to comment.
