Prosecution failure leads to acquittal of Bank cashier from charge of giving 'fake currency' | | | Jammu, Nov 19 : Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Ali Mohd of DrabaSurankote, District Poonch a bank cashier who was facing charge of giving fake currency notes for salary to police official. Principal Sessions Judge Poonch Jaffer Hussain Beigh after hearing both sides observed that I have no hesitation to hold that the accused did not possess those currency notes which has been produced by PW1 before J&K Bank Surankote. "In view of this Court is of firm opinion to hold that the prosecution has failed to prove its case against the accused under section 489-B and 489-C of RPC and accordingly the challan is dismissed and the accused is acquitted, Court said. Court said the accused stands released from his bail bond and also directed that the fake currency shall be destroyed after the period of appeal. According to the police case that on 13/1/2009 at 1515 hours complainant Sgc No.287/AP 9th lodged a written report with Police Station Surankote alleging therein that while disbursing the salary for the month of November/December 2008 on 7/1/2009 by J&K Bank Draba to the tune of Rs.19000/- out of which 14 currency notes of Rs. 500/-each amounting to Rs. 7000/ were fake. On the basis of this report FIR No.09/2009 for offence under sections 489-B and 489-C RPC was registered at Police Station Surankote and case was conducted by ASI Ali Mohd Mir who recorded the statements of the witnesses u/s 161 Cr.P.C, sent the alleged currency notes for FSL after getting them resealed and after completion of investigation established offences u/s 489-B and 489-C RPC against the accused Ali Mohd who being the Cashier of J&K Bank Draba has found to have handed over the 14 fake currency notes of Rs.500/to the complainant.
