HC asks govt to take stand on raising infrastructure damaged in floods | | | Early Times Report
Srinagar, Nov 19 : The high court has asked government to take a stand on applications, seeking permission for repairing or reconstruction of houses or establishments damaged by recent floods within Dal Lake. As the hearing in a PIL titled IqbalTahirGeelani V/s state, started before a division bench comprising Justice M H Attar and Justice D S Thakur, Z A Shah, Senior Advocate and Amicus Curiae, submitted that in the wake of the recent floods, it has been brought to the notice of the court by LAWDA and some applicants that many structures have suffered damages. He submitted that these applications are made by those whose houses have either collapsed or have suffered damages and they have sought permission to reconstruct their houses or repair them and other establishments. He submitted that the court order is in force since 2002 which prohibits undertaking any kind of construction activity within 200 meters from the fringe of Dal Lake. In this factual scenario, he said, the state government shall have to take policy decision which may include shifting of these persons some other areas by providing them alterative sites. He also submitted that Advocate General has to take a stand before the Court in this behalf. "The submissions made at bar by the Amicus do need serious consideration by the Court as also by the state government," the bench said. "In order to enable the state to disclose its stand before the Court, we direct this case to be listed on 24 November as case No 1." The bench also directed the Vice chairman LAWDA to remain present in the Court on next date of hearing of the PIL. |
