| Complaint against DEO Kathua, ors | | | ET Report
KATHUA, Dec 5: Former president of Bar Association Kathua, Advocate Arvind Kumar has filed a complaint against District Election Officer, Kathua and others.
The complaint reads: "The Returning Officer 65-Kathua Assembly Constituency namely G. Prassana Ramaswamy, Addl. Deputy Commissioner Kathua vide his Order dated 12/11/2014 imposed pre-censorship while ostensibly under the mandate of Section 144 Cr.P.C.
That the applicant being an advocate stood for one of his client and moved revision in the Court of Learned Principal Session Judge Kathua who while sensing the misuse of Section 144 Cr.P.C. stayed the operation of Order of Returning Officer 65-Kathua Assembly Constituency namely G. Prassana Ramaswamy, Addl. Deputy Commissioner Kathua dated 15/11/2014."
The complainant stated that in order to browbeat the Court in subjugation and being frustrated by issuance of order staying the Order of Returning Officer 65-Kathua Assembly Constituency namely G. Prassana Ramaswamy, Addl. Deputy Commissioner Kathua started misusing the powers vested in himself be it as Returning Officer or Addl. District Magistrate. This fact is reflected in notice issued by him from time to time with malafide intention to derive the sadistic pleasure of tormenting the person.
The complainant's counsel submitted that in reply to one show cause notice, when the applicant approached the office of Returning Officer 65-Kathua Assembly Constituency namely G. Prassana Ramaswamy, Addl. Deputy Commissioner Kathua, alongwith his client, applicant was arrested and wrongfully restrained. It is mentionable here that officers namely G. Prassana Ramaswamy, Addl. Deputy Commissioner Kathua got Doctored the proceedings and in criminal consultation with D.E.R.O. to counter the strike of the advocates got Govt. employees on strike. It is mentionable here that the versions of the employees leader who spoke against the applicant are recorded and are with the applicant (as the present complaint is sent through web their version is not uploaded).
He further stated that in order to frustrate the mandate of democracy, the Returning Officer 65-Kathua Assembly Constituency namely G. Prassana Ramaswamy, Addl. Deputy Commissioner Kathua in conviance with D.E.R.O. Kathua got issued an Order under the mandate of Cable Television Regulation Act 1995, thereby seizing the equipment and building premises of City News Kathua on 22/11/2014 on self concocted basis.
It has been further submitted that the aforesaid Order of District Magistrate Kathua was got stayed by the High Court of Judicature of J&K at Jammu vide OWP No. 1840/2014 and CMA No. 2380/2014 dated 25/11/2014.
"That despite the aforesaid Order, Returning Officer and D.E.R.O. Kathua ignored with contemptious language the Order of the High Court of Judicature of J&K at Jammu (for which further procedure has been adopted by the client)," he said.
He added that the R.O. and D.E.R.O. does not obey the guidelines issued by the Election Commission dated 05/11/2014 for print and electronic media and does not want to obey the Order of Learned Principal Session Judge Kathua and of High Court of Judicature of J&K at Jammu just to derive sadistic pleasure, just to give undue advantage to their chosen few. |
