SIC directs DFO Reasi to allow inspection of records | | | Early Times Report JAMMU, Dec 8: The Divisional Forest Officer (DFO) Reasi has been directed by the State Information Commission (SIC) to allow inspection of official records by an applicant who had sought some information under Right to Information Act (RTI). As the information was voluminous in nature, the SIC Jammu office has directed the DFO who is also the Public Information Officer (PIO) under JK RTI Act 2009 to allow inspection of the documents which the applicant has been trying to get under RTI Act. As per details available with Early Times one Mohammad Ayub Ayan, son of Abdul Ahad resident of Mahore, District-Reasi moved an application dated 22.04.2014 before the PIO/Divisional Forest Officer, Reasi under the Jammu & Kashmir Right to Information Act, 2009 where-in he sought certain information. The PIO/Divisional Forest Officer, Reasi Forest Division vide his office No. DFO/RFD/RTI/842-43 dated 08.05.2014 provided the requisite information relating to query No.1 to the applicant. However, rest of the information could not be provided to the applicant on the grounds that the information requested involves enormous amount of data since 1996 which according to DFO office Reasi was not available in the format in which the applicant has requested. Moreover, the information requested requires compiling from different records which will disproportionately divert the resources of public authority and shall adversely affect the routine office work. PIO/Divisional Forest Officer, Reasi Forest Division on the aforesaid ground denied the information to the information seeker under section 7(9) of J&K Right to Information Act, 2009. However, the PIO requested to the information seeker to visit the Division office on any working day during office hours and check the office record as per his requirement. Feeling aggrieved of the aforesaid order of the PIO/Divisional Forest Officer, Reasi Forest Division, the appellant preferred first appeal which was disposed of vide order No. CFWR/ RTI/2765-66 dated 08.08.2014 by Conservator who is the First Appellate Authority (FAA), of Forests, West Circle, Rajouri with a direction to the Divisional Forest Officer, Reasi/PIO to present the desired record and information to the applicant if he desired to visit his office on any working day. "From the aforesaid facts and observations, it is apparent that the information requested by the information seeker is voluminous in nature and its preparation and compilation may disproportionately divert the resources of the public authority and also paralyse the normal day-to-day routine functioning. In the given circumstances, the order of the First Appellate Authority/Conservator of Forests, West Circle, Rajouri is upheld and the PIO/Divisional Forest Officer, Reasi Forest Division is directed to allow an opportunity to the appellant to inspect the record in his office on a working day during office hours and provide him certified copies of the relevant documents, if any, requested by the information seeker," reads the SIC order issued by State Information Commissioner Dr S K Sharma on 12.11.2014 |
