HC stays Govt decision on mining auction

Jammu, Apr 22 (JNF) : In a petition filed by Stone crushers of Jammu Divisions challenging the controversial SRO 105 of 2016 dated 31.03.2016 by which the Govt planned to give lease of huge mining blocks of several hectares in one go, Justice Mohammad Yaqoob Mir of J&K High Court Jammu Wing after hearing Adv Vikram Sharma for the petitioners whereas AAG Ajay Sharma appearing for the petitioner, ordered that auction process so initiated shall not be carried into effect.
The petition was filed by Upkar Stone Crusher, Swastik Stone Crusher, Shubam Stone Crusher, Prime Stone Crusher, Mahavir Enterprises and New B.N. Stone Crusher challenging Govt SRO. During the course of hearing Adv Vikram Sharma appearing for the petitioner submitted that the respondents have ignored an important fact that a contractor paying enormous amount for lease of a huge Block would, in order to recover back such amount, charge the petitioner units for each excavation of the raw material from his Block in addition to the royalty to be paid to the respondents, thus undisputably raising the cost of end-product manifolds.
It is estimated that a vehicle of crushed-stone earlier costing Rs. 3500/- to an end-user/common man would under present system be costing Rs. 10000/- to Rs. 12000/- per vehicle. It is submitted the respondents can not be considered ignorant or unaffected by the steep rise in cost its notifications/documents impugned would have on the building raw-material making it almost unaffordable for the common masses.
The respondents can not be concentrating in catering to the financial interests of the mighty contractor at the cost of the lakhs of common people looking for a home/shelter for themselves.
Given the operationalisation of the notifications impugned, the common man's dream of a shelter would be almost impossible.
Justice Mohammad Yaqoob Mir after hearing Adv Vikram Sharma for the petitioners whereas AAG Ajay Sharma for the state in length observed that the respondents authoirtries are bround to be abide by the conditions of the press release dated April 16, 2016 in which it has been submitted that during the three months extraction by exiting quarry holders/ consumers/ carriers by paying royalty which means auction process initiated in terms of Sro 105 of 2016 is not be carried out into effect and directed to file objections within three weeks.
