Police-fraudster nexus exposed, Bank Manager implicated in fake case

Jammu, Apr 24: Police-Fraudster nexus has been exposed in the court of Chief Judicial Magistrate, Jammu where during the preceding it was established police has hatched victim in fake case.
In a case, Police Station Janipur versus Rajesh Sharma, the court observed fake documents procured and manufactured by complainant in connivance with police to implicate a Bank Manager, a bogus case. The special Municipal Mobile Magistrate Jammu MR Chak, dismissing a challan against Rajesh Sharma son of Rattan Dev Sharma resident PatoliMangotrian, raised question on Police's biased investigation.
"Applicant, Surinder Kumar Gupta, filed application against Rajesh Sharma at Police Station Janipur, alleging that former had received Rs 5 lacs, to get appointed wife of the complainant as clerk in J&K", sources said, adding that accordingly, Janipur Police registered a case of cheating against Rajesh Sharma. However, during proceeding of the case in court of CJM, Jammu it has established that a biased investigation into the fake case was conducted by Investigation Officer.
The victim had purchased a house from the father of complainant, few days of registration of house on the name of Rajesh Sharma, the complainant hatched to conspiracy against the victim, demanding Rs 5 lacs, apart from the payment made by Sharma to the father of complainant.
"As per the FSL opinion, the alleged writing of the receipt "Q1" does not tally with the writing of the accused (Rajesh Sharma) though his signatures are stated to be similar as that of the accused. The document seems to have been procured and manufactured by the complainant (Surinder Gupta) in order to fix the accused in this case since he failed to oblige the complainant by making additional/ enhancement payment of Rs. 5.00 lacs", noting of the case read.
"Investigating officer has conducted the investigation in a biased manner by ignoring all relevant documents provided by the victim. It is he, who at the instance of complainant has tried to build a castle in the air on these false and frivolous grounds against the accused", copy of CJM's judgment read.
"The accused (victim) and his wife purchased the house from the father of the complainant by paying their hard earned money but after delivery of possession, complainant's mouth started watering for more money and that is why on his refusal to pay, he has been implicated in this FIR for no fault of his", the judgment read, and added that Criminal Courts must rise the occasion and lift the veil to unearth true facts so that innocent is not subjected to criminal prosecution on account of false accusation.
"The persons entrusted with the investigation of the cases should not transgress their powers to innocent at the behest of strong and mighty and a note of caution deserves to be given to them by their high-ups", CJM directed to high-ups of police department.
