Contempt petition against SVO IGP, SSP transferred to divn bench
Rs 27 cr liabilities in Housing Board

Jammu, Sept 19 : High court judge B S Walia has transferred to the division bench a petition, seeking initiation of contempt proceedings against SVO (state vigilance organisation) IGP and then VOJ SSP for not completing preliminary inquiry in the alleged creation of Rs 27 cr liabilities in the Housing Board within 15 days.
"It is deemed appropriate that the matter be listed before the division bench of this court in the week commencing September 19, 2016 after obtaining proper orders from the high court Chief Justice," he said.
The court directive came in a petition, seeking initiation of contempt of court proceedings against SVO IGP Alok Puri and then VOJ SSP Koushal Kumar for not finalizing the preliminary inquiry within 15 days as fixed by the Apex Court in the case titled Lalita Kumari v/s state of UP and others wherein it was ruled that a preliminary inquiry in a corruption case should not exceed 15 days.
Earlier, the petitioner's counsel drew the court attention towards the inquiry report submitted by 3- members committee constituted vide government order No 178-HUD on July 14, 2015 to enquire into the works executed by the housing board.
He claimed that the inquiry report had established a big scandal in the housing board. In the latest status report filed in the court, the SVO IGP stated that in order to verify the element of favouritism and undue pecuniary advantage to the blue-eyed contractors, SVO has initiated a verification in the matter which is under probe.
Justice Walia said in view of the public interest involved in the instant petition, it 'warrants to be heard by a larger bench as per the amended writ proceedings rules'.
After hearing the two sides, Justice Walia transferred the contempt petition to the division bench and directed registry to list this matter before the division bench after obtaining proper orders from the high court Chief Justice.(JNF)
