CJM issues summons to MLC's son, sister in thrashing case

jammu, Oct 8: The Chief Judicial Magistrate (CJM), Jammu has issued summons to son and sister of a sitting MLC in a case of alleged beating on 31.10.2016.
As per petition, a complaint was filed before the court of CJM on September 7 with the request to forward the same to Station House Officer (SHO) Channi Himmat police station for registration of FIR in terms of section 156 (3) CrPC.
Since the incident was stated to have taken place on June 25, as such as per the directives of Supreme Court in the 'Lalita Kumari Case', the matter was sent to SHO Channi Himmat for verification of contents of the compliant.
SHO Channi Himmat submitted the report on September 29 wherein he concluded that the complaint is not based on facts and as such, he had not proved the commission of any cognizable offence in the said complaint.
After receipt of the negative report from SHO, Advocate Deepika Singh Rajawat, the counsel for the complainant, insisted for taking cognizance of the complaint. The court directed the complainant to produce evidence in support of his complaint.
The complainant bedsides appearing in the witness box has produced two witnesses namely Rattan Chand and Harminder Kour in his support.
From the perusal of the statement of Harminder Kour who alleged to be the victim in the said occurrence has stated that on the day of occurrence i.e in 25-06-2016 at about 1 P.M all the accused persons took forcible entry into her residence along with the construction material and they had intended to construct a wall in her residential house.
On smelling some foul play, she had telephonically informed her husband i.e the complainant. When her husband came reached there, he had also resisted the accused and asked them not to raise any construction. But the accused persons did not pay any heed to his request and started breaking the door of her house. It is also stated by her that the accused persons son of a MLC and his sister had forcibly broken their door of the house for the reason that she had locked the said door and the accused persons did not took it as good taste.
Thereafter, the accused persons had also beaten and injured her. It is alleged that the accused persons then in-charge police post Sainik colony remained standing there as spectators and they did not stop the accused from damaging the property.
It is also alleged other two accused, were taking instructions from a person who happened to be the brother of the accused.
Similar statement has been given by the complainant Major Harnam Singh and Rattan LaL, who were also allegedly present on the spot at the time of occurrence.
