| HC stays election notification of Sainik Cooperative Housing Society | | | Et Plus Report
Jammu, Mar 20: J&K High Court today stayed holding of the elections to Managing Committee of the Sainik Coopertaive Housing Society on various grounds. In a petition filed by Capt Suraj Bhan and others challenging the holding of the elections to Managing Committee of the Society on various grounds, Justice Tashi Rabstan of J&K High Court issued notice to State of J&K through Com/Secy Govt Cooperative Dept, Registrar Cooperative Societies J&K Administrator Sainik Cooperative Housing Society and Kuldeep Raj Returning Officer and stayed the operation of the election notification dated February 12, 2013 till next date of hearing before the Bench.The petitioners had challenged the holding of elections on the ground that Supreme Court of India has directed to review the rule relating to the elections within one month and hold elections thereafter within two months. It has been further submitted that Apex Court too has ordered the holding of election only after the rules of election are reviewed.The petitioners prayed before the Court that the elections cannot be held under the supervision of Administrator whose term has expired and "administrator and returning officer are biased against the petitioner and seeking quashment of the election notification.
