DB grants last opportunity to state for filling compliance report

Jammu, July 29 : In a much publicized Public Interest Litigation against alleged nexus of politicians, police officers, bureaucrats with land mafia/under world in various part of J&K for land-grabbing, today Division Bench of State High Court Comprising Justice Virender Singh and Justice Ali Mohd Magrey after hearing battery of lawyers from both sides granted last opportunity with three weeks time to the state for filling compliance report.
While granting last opportunity, Division Bench further observed, otherwise; it shall be presumed that the state has no stance to put forth atleast on facts.When the PIL came-up for hearing, Sr. Additional Advocate General Gagan Basotra Vice AAG HA Siddiqui, who is handling the instant PIL on behalf of the state, sought some more time to comply with order dated July 3, 2013.
According to the earlier order, Division Bench on May 21, 2013 directed Commissioner/Secretary General Administration Department and Revenue Department to file their affidavits indicating as to how much land in respect of ownership rights have been conferred under the Jammu & Kashmir State Lands (Vesting of Ownership to the Occupants) Act, 2001. In the application filed by Prof SK Bhalla The State authorities shall also disclose in the affidavits as to how many cases under the Jammu & Kashmir State Lands (Vesting of Ownership to the Occupants) Act, 2001 are under process along with the names, persons & quantities of land on which ownership rights are sought. This direction has been filed in an application filed by in which he referred a reply to a question in Assembly with regard to illegal occupation of state land by the Land Mafia in the State of J&K.
In the reply submitted by the Revenue Dept substantiated the issue raised in the instant PIL and District wise encroachment of State land running more than 20 lacs Kanals and seeking appropriate direction to be issued to the Commissioner/ Secretary Revenue Dept to submit the detail of all the occupants of State land including the list of all so called VVIPS who have illegally grabbed State land running into lacs of Kanals are indicated in the reply and also seeking constitution of Special Investigating Team comprising of officers having impeccable integrity who should report directly to the State High Court about the action taken in the matter so that the state land under occupation is retrieved.
