Accused cheater acquitted

Jammu, July 29 : Principal Sessions Judge Poonch Kishore Kumar has acquitted Mohd Rashied S/O Ahmed Din R/O Shahpur Tehsil Haveli,District Poonch who was facing trial in fake PRC & Mark-sheet Scam. According to the police case that Ghulam Hussain S/O Mohd Hussain, Abdul Rashied S/O Ahmed Din and Nazir Hussain S/O Ghulam Mohd caste Gujjar Kalas R/O Shahpur were involved in managing forged qualification certificates/ category certificates and PRC and inducing the illiterate youth of the area for getting Govt. employment on the basis of forged certificates and they were extracting money as consideration from the illiterate youth etc. In this regard a direction was issued by the then Sr. S.P. Poonch to register a case under appropriate sections of law and take up the investigation. An FIR No.12/02 was registered and the investigation was entrusted to Abdul Ahmad ASI .I.O ,who after investigation came to the conclusion that the accused namely Mohd Rashied S/o Ahmed Din R/O Shahpur was involved in the commission of offence u/Ss 468/470 RPC.On finding a prima facie case accused named above was charged for the offence punishable u/s 420/473 to which he pleaded not guilty and claimed trial. Prosecution was directed to lead the evidence in support its case. Principal Sessions Judge Poonch Kishore Kumar after hearing both the sides observed that In the present case, looking to the evidence on record, Court is of the view that prosecution has failed to prove the guilt of accused by cogent and clear evidence and no conviction can be handed out merely on suspicion.
For it is a settled law that Mere suspicion, however, strong or probable it may be is no effective substitute for the legal proof required to substantiate the charge of commission of a crime and grave the charge is greater should be the standard of proof required. With these observations Court acquitted the accused.
