| DB directs State to comply with SC directions | | PIL on restriction of sale of acid | | Et Report
Jammu, Sept 3: In a Public Interest Litigation (PIL) regarding implementation of Supreme Court judgment on harassment of females at work place and other public places and restriction on sale of acid, Division Bench of High Court directed Chief Secretary and Principal Secretary Home that they shall also follow and comply with the directions issued by the Apex Court and ensure control and regulation of sale of acid in every Sub Divisions by vesting power with the Sub Divisional Magistrates. The PIL has been filed by Dr Davinder Singh Jasrotia, Dr Tejinder Kumar, Dr Jang Bhadur Singh, Dr Harsh Sharma and Dr Kailash Chander. The DB comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Advocate Rohit Kapoor for the petitioners and senior AAG Gagan Basotra for the state directed that needful be done within four weeks and compliance report be also filed. The DB said that in case needful is not done within the said period, the Secretary Home shall remain present in Court to explain his conduct why from December 12, 2012; the directions have not been carried. The DB allowed one last opportunity to Chief Secretary and Principal Secretary Home to file detailed status report and plan to implement the directions issued by the Apex Court as well as J&K High Court. It further said that in another related issue raised by Adv Rohit Kapoor appearing for the petitioners with regard to sale of acid and other coercive substances, the Union of India has framed some rules. The Apex Court has issued directions that over the counter, sale of acid is completely prohibited unless the seller maintains a log/register recording the sale of acid which will contain the details of the person(s) to whom acid(s) is/are sold and the quantity sold. The log/register shall contain the address of the person to whom it is sold. All sellers shall sell acid only after the buyer has shown a photo ID issued by the Government which also has the address of the person and specifies the reason/purpose for procuring acid and so many others.
