| HC issues notice in PSA detention case in Kishtwar riots | | | Early Times Report
Kishtwar, Sept 18: High Court of J&K, Jammu comprising of Justice Hasanain Massodi has issued notice to the State of J&K through Commissioner/ Secy to Government Home Deptt, Distt Magistrate Kishtwar, SSP Kishtwar and SSP Central Jail Kot Bhalwal Jammu in a Habeas Corpus writ petition filed by one Sajjad Ahmed Najar son of Abdul Gaffar Najar resident of Jamia Masid Mohalla Kishtwar Distt Kishtwar though counsels A K Sawhney and Aseem Sawhney Advocates, who has been detained under Public Safety Act by order of the DM Kishtwar for Kishtwar riots .The Court in an order announced in the Court after hearing Advocate Aseem Sawhney has directed the State Counsel to be ready with reply and record in the matter and listed the matter for further consideration on Sept 23, 2013. The petitioner who is presently under custody at Central Jail Kotbhalwal Jammu has sought the quashing of the Order of detention passed by the DM Kishtwar NO. DCK/13/507-14 dated 30.8.2013. It has been alleged that he has been victimized and booked under Public Safety Act and the order is apparently and patently illegal and passed on pure non application of mind, mechanical in nature, arbitrary and just to personal scores and with the petitioner. It was alleged that aggrieved by illegalities of the Addl Distt Magistrate Kishtwar and the Police the petitioner filed a petition in the High Court, which is numbered as Cr Rev 70/2012 titled Sajad Ahmed Najar V/s State & Others. |
