| Jammu, Sept 20 : The Court of Principal Sessions Judge, Jammu, presided by Kartar Singh (Judge), acquitted Ghulam Ahmed Mir and Riaz Ahmad Khan both residents of Thanamandi of the charge framed against them u/s 3 of Enemy Agents Act. The court directed to release the amount recovered from them, in their favour and to destroy other articles after the expiry of period of appeal. As per the prosecution case, on the written report of one Major Adjutant of 13 Rashtriya Rifles Regiment a FIR No. 129/2004 for the commission of offence falling under section 3 of Enemy Agent Act was registered. On 2.9.2004, Army intercepted a Sumo (JK11 - 2313) at Manial Gali Rajouri and found Ghulam Ahmed Mir, Raiz Ahmad Khan, Hazra Begum and two children, one boy and one girl aged 8 to 10 years, travelling in the vehicle. The vehicle was checked by the security forces and on its checking Rs 57240, one telephone diary, visiting card, five money order receipts were recovered from the accused Mir and letter pad of Hizbul Mujaheedin, driving licence, one personal letter and passport application receipt of Riaz Ahmed Khan were recovered from the accused. Prosecution pressed that recovery was suggestive of objectionable activities by the accused Ghulam Ahmed Mir in order to transfer funds to terrorists from one place to another. In order to prove these allegations against the accused, the prosecution examined nine witnesses but they failed to implicate the accused for the commission of alleged offence in any manner. |
