JAMMU, Sept 20: For the first time State Information Commission (SIC) has warned an RTI applicant who allegedly used RTI Act to get the personal benefits by mounting pressure on the officials of Chief Agriculture Office Kishtwar . The RTI applicant according to officials wanted some contract by illegal means and when the same was not given to him, he resorted to pressure tactics by filing applications under RTI. When the applicant was asked to deposit the xerox fees by the office of the CAO Kishtwar he knocked the door of SIC.
As per details available one Raj Kumar S/o Mohan Lal a resident of Village Keshwan, Tehsil and District Kishtwar moved an application dated 05-02-2013 before the PIO/Chief Agriculture Officer, District Kishtwar seeking Information regarding execution of Soil Conservation Scheme in respect of Block Kishtwar along with detail of work Panchayat wise, Location and name of contractor/executing agency for Land Leveling, Gully control & DPAP, Nallah Erosion and BRGP etc. with detail of works executed under the kind control of soil Conservation Assistant Kishtwar for the period w.e.f 2009 to till date and furnish the copies of estimates, M.B & final Bills of the works executed in Block Kishtwar for the above said period.
The applicant sought detail of beneficiaries alongwith the name, parentage and address of the beneficiary with copy of Receipt thereof and Water Shed Work executed by Agriculture Department in the Block during 2012-13. After receiving the RTI application of the information seeker, the Chief Agriculture Officer, Kishtwar endorsed the same to the concerned officer for furnishing the requisite information to the information seeker vide office No:Dev-77/2012-13/3982 dated 12- 02-2013.
According to the reliable sources the concerned Assistant Soil Conservation Officer, Doda/ Kishtwar asked the applicant to deposit an amount of Rs.1462/- which the applicant has never deposited .
The PIO/ Chief Agriculture Officer, Kishtwar reported to the State Information Commission (SIC) vide No:Dev-77/2013-14/1669-70 dated 3-8-2013 that the applicant was approaching the concerned Field officer of the district for allotting some Soil Conservation works by filing RTI applications and the applicant was asked by the concerned subordinate Field Officer to wait till allotment of funds for consideration of the request of the applicant. The PIO also reported that the applicant never deposited the amount asked for instead remained quite silent for about two months.
While warning the Information seeker the SIC advised the applicant to desist from such activities in future to make use of RTI only for genuine and bonafide purposes.
