Sources said after receiving the sanction from the union government for prosecution of Baseer Khan, the state government has given a green signal to the SVO to proceed further in the case more so because the J&K High Court has given four weeks time to the Union Government for sanctioning prosecution of the accused IAS officer.
In its last order issued on July 19, 2013 the Division Bench comprising Justice Mansoor Ahmad Mir and Justice Tashi Rabstan had granted four weeks time to the Union of India for sanctioning prosecution of Khan in the Gulmarg land scam and DoPT has ensured compliance of the same within the stipulated time-frame by granting prosecution sanction. Earlier, in compliance to the directions of the Division Bench passed on August 28, 2012, the State Government had forwarded the papers of Baseer Ahmad Khan to the DoPT for examination and issuance of necessary orders. However, the accord of prosecution sanction took time for want of certain clarifications sought by the DoPT after the initial examination of the documents.
Meanwhile sources further said that Khan will be produced before the court on Monday personally by the SVO at the time of producing chalan against him in the court. They said the SSP vigilance Kashmir has been tasked to make arrangements for bringing Khan from Kishtewar to Srinagar. However, it remains to be seen whether Baseer Ahmad Khan will appear before the court personally.
