| CJM convicts father to 6 months; son to 3 years jail, fine | | | Early Times Report
Jammu, Sept 20: The Court of Chief Judicial Magistrate, Jammu, presided by S R Gandhi, convicted two accused Himmat Singh and his son Rocky Singh of trespassing and inflicting grievous injuries to the one Naresh Kumar of Govindpura, Kulian. The court sentenced Himat Singh a simple imprisonment for six months and a fine of Rs 500 and to his son Rocky rigorous imprisonment of three year and a fine of Rs 1000. On 27.08.2001 Naresh Kumar accompanied by Amar Kumar in an injured condition lodged a report in the Police Post Chatha alleging that accused Himmat Singh and his son, who had an old enmity with him, trespassed in his residential room with criminal intention. Accused Rocky was armed with a Kirchi whil Himmat Singh caught hold of him from the arms and Rocky inflicted a kirch blow on his back and injured him. He raised alarm and on hearing it a few persons reached on spot. On seeing them both the accused persons ran away. An FIR for the commission of offences under section 452/324 of RPC and 4/25 Arms Act was registered in the police station Satwari. Passing the detailed judgment, and after hearing the counsel appearing for accused and Public Prosecutor for prosecution, the court observed that the nature of the injuries inflicted to the injured which could have proved fatal for him, the accused persons cannot be given the benefit of the Probation of Offenders Act. |
