| Bail application of two rapists rejected | | | Early Times Report Jammu, Oct 26: Presiding Officer Fast Track Sanjeev Gupta today rejected the bail application of Naresh Kumar and Rakesh Kumar both residents of Village Barn Tehsil & District Jammu who was allegedly involved in a rape case. According to the police case that on the day of occurrence proseuctrix was going to her home when both the accused dragged her in a field where she was raped by both of them one after other by intimidating her with a Toka which petitioner Rakesh Kumar was carrying with him. Police after gone through the complaint lodged a FIR NO 81/2013 for the offences u/s 376-g/341 RPC and 4/25 Arms Act has been registered by P/S Gharota and accused were arrested on September 9, 2013. Court after hearing APP GS Charak for the State observed that rapes offences constitute a class apart and need to be visited with a different approach in the matter of bail. Such offences needs to be viewed seriously and considered as grave offences affecting the society as a whole and thereby posing serious threat to the public sentiments. After gone through the CD file, Court finds that there is a prima-facie case against the petitioners with regard to the commission of gang rape with the prosecutrix which is also supported by the FSL report and with these observations Court dismissed the bail application of both the accused. —JNF |
