| HC asks DCs to file status reports on quarrying | | | S Sabaqat Srinagar, Oct 29 : Jammu and Kashmir High Court on Tuesday asked all Deputy Commissioners except Doda, Poonch and Reasi to file status report within three weeks on halting quarrying activities in forest areas. The direction was passed by a division bench of the court comprising Justice Mansoor Ahmad Mir and Justice Ali Mohammad Magrey while hearing a Public Interest Litigation filed by one Sofi Arif Maqbool, a resident of Kupwara for an end to unabated stone quarrying within forest areas. DCs of Doda, Poonch and Reasi have already file the reports. The division bench had also directed Divisional Commissioners of Jammu and Kashmir to file compliance report about the implementation of court orders passed on September 4. Then, the court had issued the direction after advocate G Murtaza, representing the petitioner, had highlighted violation of court orders with impunity. The division bench also gave liberty to the government to file response or suggestions within the three weeks regarding the policy of the state for rehabilitation of those persons who have been adversely affected by stopping quarrying operation. The petitioner has filed the PIL seeking directions for halting the quarry activities in the forest demarcated areas of the state. The PIL states that there is an indispensable need to stop quarrying activities in the forest areas, stating that if the activates go unabated, then forests will suffer from an irreparable loss and it would be impossible to make up for the ecological and environmental disaster resulting from the quarrying activities. The petitioner had said that the action taken in this regard by Forest Department was only restricted to papers. |
