| DB grants last opportunity to counsel of mainstream BJP MLAs | | PIL seeking CBI probe in cross-voting in MLC elections | | ET Report
JAMMU, Oct 30: In a much publicized public interest litigation filed by SOS International and other seeking CBI probe regarding cross-voting in MLC elections, today a Division Bench of the state High Court comprising Justice Hasnain Massodi and Justice Tashi Rabstan granted last and final opportunity to Sr. Adv Sunil Sethi who was appearing on behalf of five main stream BJP MLAs.
The DB passed the direction after hearing Advocate Sheikh Shakeel Ahmed appearing for the petitioner and Senior Additional Advocate General Gagan Basotra appearing for the state, Advocate Harshvardhan Gupta appearing for the Prof Chaman Lal Gupta, Gharu Ram and Bharat Bhushan alias Bodhi, Sr. Adv Sunil Sethi with Adv Veenu Gupta appearing for MLA East Ashok Khajuria, Sukhnandan Choudhary, Jugal Kishore Sharma State BJP President, Baldev Raj Sharma MLA Reasi and Sham Choudhary MLA Suchetgarh and Adv Rahil Raja vice Advocate SK Shukla appearing for Jagdish Sapolia MLA Basohli and Lal Chand MLA Billawar, Division Bench on the insistence of the petitioners' counsel for an early date and for earlier disposal of the PIL, directed the consideration of this matter in the week commencing December 9, 2013 and Division Bench made it clear that in the event reply is not filed, the right to file reply shall stand forfeited and matter taken-up for consideration in absence of reply.
In the identical petition seeking similar relief, Division Bench after hearing Adv Aditya Gupta appearing for the petitioner and the battery of lawyers for BJP MLAs allowed four weeks time for filing reply and also made it clear that in the case the reply is not filed, the right shall stand forfeited. |
