Srinagar, Nov 18: A single bench of Jammu and Kashmir High Court has directed maintainance of a status-quo on a house construction by senior National Conference leader and Minister for CAPD Choudary Mohammad Ramzan for allegedly violating master plan for a residential colony in Budgam district of Kashmir Valley. A bench Justice Bansi Lal Bhat passed the directions on a petition filed by one Dr Ghulam Nabi Yatoo, a resident of Friends Enclave Humhama in the central Kashmir district. The Minister is alleged to have managed permission for raising the double storied residential house on two plots from Srinagar Municipal Corporation in whose jurisdiction the area falls. Under the garb of the permission, Ramzan is said to have raised the construction in clear violation of the sanctioned master plan on the plots "after grabbing the public lane and green strip reserved for beatification of the colony." The court also issued notice returnable within four weeks to official and private respondents including the minister in the petition. "This direction shall be enforced and implemented by Divisional Commissioner Kashmir who will take all necessary measures to prevent any further construction activity on spot," the court said. The petition has been filed against J&K State through Chief Secretary, Commissioner/ Secretary Housing and Urban Development Department, Divisional Commissioner Kashmir, Deputy Commissioner Srinagar, chairman Building Operations Controlling Authority, Ex-Registrar Cooperative Societies and incumbent chairman BOCA/Commissioner SMC, Dr G N Qasba, Chief Enforcement Officer SMC, J&K Cooperative Housing Corporation Ltd through Managing Director, chairman Friends Enclave-cum-Welfare Cooperative Humhama Heights, Choudary Mohammad Ramzan, his son Asif Afzal Choudary, Haji Ghulam Ahmad Wani of Handwara and ward Officer 33, SMC. In his petition, the petitioner seeks quashing of the order permitting Ramzan to raise the construction of the house at the site.
