| Vigilance seizes fake 'Latha' of Chowadhi area | | Alleged illegal construction along Chowadhi Nallah | | CM seeks status report; senior Revenue, Police officers in soup Sumit Sharma JAMMU, Dec 5: The much hyped alleged illegal construction along the Chowadhi Nallah near Sharma Resorts took a new turn when Vigilance sleuths seized the fake 'latha'(Map) of the area from the possession of the local patwari in presence of Tehsildar (Settlement) Jammu and dozen other serving and retired revenue officers who had assembled at the site for the purpose of demarcation of khasra no 887 min village Chowadhi on the request of Vigilance Organisation Jammu. VO is enquiring into the complaint of Shashi Thakur, DySP in which she has alleged that a false and frivolous case was registered against her at police station Channi on October 2012 by local police in connivance with the land mafia for raising her voice over the illegal construction along Chowadhi Nallah. Pertinently, Channi Police registered the case against DySP Shashi Thakur based on the court direction. The complaint against her was filed by one Ashiq Hussain who in his complaint alleged that the DySP was interfering in his land. On Tuesday, a joint team of Vigilance and Revenue officials had assembled near the Chowadhi Nallah for demarcating the alleged encroachment/construction on and along the Chowadhi Nallah. The vigilance sleuths were stunned when they noticed that the "latha" brought by the local patwari was without any authentication and didn't bear any signature and stamp and the khasra no in question was totally different from the akas tartima of the construction site. Vigilance sleuths seized the 'latha' when Tehsildar (Settlement) Jammu refused to authenticate the 'latha' and concerned patwari could not satisfy the queries of the vigilance team. As the very basic document i.e akas latha of the land was not available, vigilance team returned back without any demarcation. However, the Tehsildar (S) sought two weeks time to prepare the fresh latha on the basis of 'field books' to conduct fresh demarcation. Meanwhile, Chief Minister Omar Abdullaha as per order No 217/8/2013 has sought status report of the issue from the Vigilance Commissioner and as per highly placed sources the vigilance is all set to prepare the report to be submitted to him for further action. Sources further said that, Vigilance has also mentioning the role of IAS level Revenue Officers and senior police officials for filing a wrong reply in the High Court that demarcation of the land has been conducted and no encroachment was found. The decision regarding ban on construction work in Sunjwan Sainik Colony was passed by Double Bench of Jammu and Kashmir High Court comprising Justice Yaqoob Mir and Justice Dhiraj Thakur in response to the PIL filed by residents of the area that they have been struggling for the last two years by approaching all the concerned government machinery including, Chief Minister Grievances Cell but in vain. The petitioner has made clear that broad day light illegal encroachment of Nallah, land and Road is going on in connivance of Police, Revenue officials and politicians. Upholding the claims of the petitioner, the Double Bench of J & K High Court wide CMA No: 634/2013 dated 27-5-2013 directed nine respondents including Chief Secretary to Govt, Principal Secretary to Govt. Home department, Secretary to Govt. Revenue department, Divisional Commissioner Jammu, Deputy Commissioner Jammu, DGP J & K, SSP Jammu, besides the alleged encroacher Zakir Hussain and Ashaq Hussain both sons of Qasim Din R/o Chatta Jammu seeking their respective objections. The objection filed by DC Jammu under his seal and stamp clearly states that demarcation of the land was done and no encroachment was found on the spot. The Vigilance Organisation is also verifying the complaint filed by RTI activist SK Bhalla to Chief Minister stating that illegal construction is in progress in Sunjwan in connivance with the revenue and police officers. Sources said that while the investigation of the issue was in progress, Vigilance received another complaint of similar nature by DGP Jammu and Kashmir Police based on the complaint by a DySP rank official. Both the cases have been clubbed up by the Vigilance for investigation. Meanwhile, DySP Headquarter Jammu Rouf Lone in an inquiry report submitted that the FIR lodged against DySP Shashi Thakur in police station Channi Himmat Jammu under sections 447, 323 and 506 RPC against FIR no100/2012 has not been proved and should be closed down accordingly. Rouf Lone started inquiry on the direction of the then DIG Jammu-Kathua Range JP Singh who pointed out five laxities in the case history registered against her. Sources said that instead of producing the same before the Court, the job of new inquiry over the issue was entrusted to SDPO City West Jammu. |
