Issues promotion orders despite stay on reorganization proposal
Sports Council hoodwinks Court orders

SRINAGAR, Dec 25: Despite several of its administrative decisions challenged and stayed in the Court of law for being bad and incoherent to the laid norms, the State Sports Council has continued to issue similar orders in brazen contravention of regulations, which indicate complete administrative vacuum in the apex sports body of the state.
With its hyped reorganization proposal stayed by the State High Court on several counts, the Council has been hoodwinking the Court directions by issuing orders that violate the directions of the court in letter and spirit.
Those aggrieved by the reorganization proposal opine that two orders of the Council published recently according promotion to Ground incharge(s) as supervisors and Assistant Managers as Deputy Managers are against the spirit of the directions of the Court wherein it upheld the objections raised by certain sections of the employees of the State Sports Council who alleged discrimination against them.
Order No. 490 and 493, dated 19.9.2013 wherein ten ground incharge(s) have been promoted as supervisors and three assistant managers as deputy managers are against the spirit of the Court orders which stayed the entire re-organization proposal of the Council. "The promotions being accorded to the concerned in these orders are part of the re-organization proposal which has already been stayed by the High court pending objections by the Council, which it has failed to file within stipulated time," said an employee of the Council who sought legal redressal alleging discrimination. "Even the Commissioner Secretary Higher Education has disapproved the reorganization proposal, directing the Council secretariat to revisit the proposal.
Sources within the Council lamented that the orders are not only prejudiced against the Court orders, but also in brazen violation of the recruitment rules of the Council. "According to the recruitment rules, an aspirant to the post of supervisor must be a graduate with career in sports or should have a diploma in coaching from the national institute of sports; but none of the ten people promoted as supervisors fulfill any of these qualifications," said another employee adding that Council does not have ten sanctioned posts of supervisors, yet ten people have been promoted in yet another violation sorts. Further, the recruitment rules also provide for half of the vacancies of supervisors to be filled by direct recruitment while no post was referred for direct recruitment.
Sources also disclose that the very constitution of DPC which recommended these promotions has been challenged in the Court and hence all orders passed on the basis of its recommendations cannot stand legal scrutiny. "Some vested interests within the Council are misguiding the present secretary to take such decisions which are discriminatory and bad in the eye of law. Dileep Thussu is an eminent engineer of the state, but he has little understanding of the Sports Council and those he confides in are settling their personal scores by misguiding him," said a senior officer pleading anonymity.
