Higher Education communication to PSC throws spanner

JAMMU, Jan 16: The recommencing of advertisement for 1289 posts of Assistant Professors is likely to face delay, as the communication sent by Higher Education department to Jammu and Kashmir Public Service Commission has stalled the process for time being.
Sources informed Early Times that in the last week of December, Higher Education department had sent a communication to Public Service Commission, asking them to re-commence the process of advertisement, following the decision of division bench in favour of M.Phil candidates.
But the communication sent by Higher Education has stalled the process for time being, sources said, adding, "In the official letter sent by Higher Education department in the last week of December to PSC, on one hand Higher Education had asked PSC for re-commencement of advertisement but at the same time, had also made it clear that they would soon challenge the decision of division bench", sources said.
They further informed that in the official letter, Higher Education has asked PSC to also consider the decision of double bench of High Court, which would come, after Higher Education approached the HC in coming days.
"After getting a conditional letter from Higher Education, the Public Service Commission authorities have reportedly stalled the process, for time being and have reportedly made it clear to Higher Education department that they would not recommence the process with such clause, imposed by Higher Education in the official communication", sources said, adding that PSC authorities have asked Higher Education to remove the condition, so that advertisement process would be started.
Pertinently, on October 3, 2013 the J&K High Court had given the judgment on the Public Interest Litigation, filed by some scholars and others, who had challenged the notification number 09-PSC (DR-P) of 2013, dated 23-03-2013, over qualification prescribed for the posts advertised.
The petitioners had contended that PSC has not shown the qualification as per Jammu and Kashmir Education (Gazetted) College Service Recruitment Rules 2008 and had secured stay from High Court.
The High Court has given decision in favour of the candidates and has reportedly asked the Higher Education department to consider the M. Phill degrees as eligibility for the posts.
The Higher Education had received the official order of High Court decision in last week of December and had forwarded a communication to Public Service Commission.
According to the content of judgment given by single bench of High Court, all the candidates who have qualified State Eligibility Test and National Eligibility Test, even after the stay, are also eligible to apply for the posts.
