| HC seeks Rs 2 lakh as financial surety for girl | | Marriage without consent of girl's parent | | Early Times Report
Jammu, Jan 17 : In a rare case the high Court directed a boy to deposit Rs 2 lakh as financial surety for the girl whom he had married without the consent of the parents of girl. This significant direction has been passed by Justice Bansi Lal Bhat in a petition filed by Roheela Koser who contracted marriage in accordance with Muslim Law on 01.10.2013 and living together as husband and wife, are apprehensive of being subjected to physical violence at the hands of parents of the girl as it is claimed that marriage inter se the petitioners had been contracted against the wishes of her parents and their relatives. The petition is supported with copy of Marks Card of girl, recording her date of birth as 25.06.1995, copies of Nikahnama, marriage agreement which prima facie support the petitioners' claim of having attained the age of majority and being eligible to contract marriage and also establishing factum of marriage having been contracted the petitioners. They are entitled to protection of their life and liberty in terms of mandate of Article 21 of Constitution of India. Justice Bansi Lal Bhat after hearing Adv Ajaz Choudhary appearing for the petitioner disposed of petition by directing State respodents to provide adequate security cover to petitioners and ensure that parents and relatives of girl do not disrupt and interfere in the matrimonial life of petitioners, who are established to have contracted marriage out of their free will and consent and are living happily as husband and wife. Court also directs husband of the petitioner to undertake to make a deposit of Rs.2.00 lac through FDR in the name of girl as a measure of financial security for her. He shall provide a copy of receipt of FDR before the Registry of this Court within fifteen days. JNF
