DB directs state to specify date for notifying draft rules for SAC
PIL highlighting inadequate staff in SAC/SVC/SIC

Jammu, Mar 4 : In a Public Interest Litigation (PIL) filed highlighting inadequate staff/ infrastructure to State Accountability Commission, State Information Commission and State Vigilance Commission, Division Bench (DB) comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar, directed state government to state to specify the date for notifying draft rules for SAC and sought an appraisal in this regard i.e. about the time needed to notify the rules.
After going through both the status reports, the Division Bench expressed its displeasure over the non-providing of the staff/investigating wing to the SAC by the state Govt. At this stage the matter was directed to be taken-up immediately after second half. In second half when the proceedings commenced Senior Additional Advocate General Gagan Basotra produced a copy of the draft rules providing mode and method for filling various Gazetted/ non-Gazetted posts for SAC. Division Bench examined the draft rules in the open Court and put a query to Senior Additional Advocate General Gagan Basotra as to how much time the law department requires to notify the said rules and to make appointments under the said rules. Division Bench also insisted for a specific time for this entire exercise and for which the Senior AAG sought a short adjournment to seek instructions from the state Govt so as to apprise the Division Bench about the time needed to notify the rules. Upon this Division Bench deferred the hearing of this PIL for day after tomorrow. During second half Senior AAG Gagan Basotra also presented in the open court the minutes of the High Power Committee Meeting held on February 21, 2014 to consider the cases of four employees recommended for compulsorily retirement and it was informed to the Division Bench that the High Power Committee did not agree with the recommendations as the cases of the said four employees were not coming within the criteria fixed for compulsorily retirement of dead-woods. Division Bench was also apprised about the cabinet decision No26/03/2014 dated February 8, 2014 when the state cabinet did not agree with the creation of 82 posts for newly created State Vigilance Commission.
Earlier Adv Sheikh Shakeel Ahmed appearing for the petitioners Sheikh Mohd Shafi & Prof SK Bhalla invited the attention of the Court to the status report filed by the J&K State Accountability Commission.
In this PIL Sheikh Shakeel Ahmed with Adv Sanjay Sharma appeared for the PIL whereas Sr. Adv Sunil Sethi with Adv Mohsin Bhat appeared for the SAC and Senior AAG Gagan Basotra appeared for the state.(JNF)
