| DG prisons orders attachment of Rajni Sehgal to ADGP Home Guards | | Former Kotbhalwal superintendent harassed in the name of probes | | Asif Iqbal Naik
Jammu, Mar 22: Under the garb of the inquiry order issued by Commissioner Secretary Home, Suresh Kumar vide order No. 131-Home of 2014 dated 12-03-2014 wherein D.R. Doley Burman has been appointed as an inquiry officer to probe the role of former jail superintendent Kotbalwal Rajni Sehgal presently under suspension since last nearly 10 months in connection with the death of Pakistani prisoner Sanaullah Ranjay inside Kotbhalwal jail last year has now been directed by the Director General of Prisons, J&K Jammu to report to ADGP Home Guard, which is in violation of the transfer policy as DG Prison without the permission of Commissioner Secretary cannot issue such an order.
As per the details available with Early Times, DG Prisons order No. 240 of 2014 with dispatch No. Esstt/2014/17457-62 dated 18-03-2014 while quoting Home department wherein ADGP Home Guard was appointed as inquiry officer to carry out formal inquiry against suspended jail superintendent in terms of rule 33 of Jammu and Kashmir civil services (Classification Control & Appeal) Rules 1956, DG Prisons stated and directed the suspended lady officer to report ADGP HG/CD/SDRF J&K, Jammu with immediate effect to felicitate the completion of inquiry against her in shortest possible time.
The order issued by the DG amounts to change in the department of the suspended officer violating the service rules. Moreover, the law states that DG Prison has no jurisdiction to issue such order and the powers lie with Commissioner Secretary Home who even can't direct the officer to report to other department.
The department's apathy towards the suspended officer can also be judged from the fact the inquiry officer has already been cleared by the Government for central deputation and can be seen as delayed tactics to harass the said lady officer. Moreover, the inquiry officer who has the real power to summon the lady officer did not issue any call latter to her and the order of DG Prisons is contrary to the order which otherwise inquiry officer could issue.
It is pertinent to mention here that suspended officer was even asked to vacate the Government accommodation despite the fact that the lady officer paid money for the said accommodation through deduction of HRA amount from her salary.
Throwing all the rules and regulations to winds, another probe was ordred by the Government and the same was conducted by Additional Secretary Home, Sudershan Kumar who under protocol cannot change the inquiry report of Home Secretary who is senior to him, followed by 3rd probe to be conducted by ADG Home Guards DR Dolley which is also in violation of rules and regulation as under normal circumstances, the inquiry was conducted by the officer from bottom to top, while in this case it is reverse in nature. |
