SRINAGAR, May 12: A Division Bench of High Court today asked the state government to file a report of more than 800 structures that have come up along the banks of river Lidder in Pahalgam tourist resort in South Kashmir's Anantnag district.
Hearing a Public Interest Litigation, the division bench comprising of Chief Justice M M Kumar and Justice Muzaffar Hussain Attar passed the direction after perusal of a compliance report filed by Chief Engineer of Irrigation and Flood Control Department, Kashmir.
Out of 1280 illegal structures identified to have come up within the 200 meters of river from Rangward and Mondlan to Nonwan Yatra Base Camp, the Chief Engineer submitted a report about 465. "These structures are stated to have come up before the date of passing of order banning constructions within 200 meters on the banks of river Lidder.
The indexing of other structures apart from 465 is still awaited and Additional Advocate General, M A Chashoo states that it will also be filed by next date of hearing," the court said. Both Justices Kumar and Attar expressed their dissatisfaction that no satisfactory answer has been given with regard to disposal of sewer waste and sold waste in the Pahalgam area. "The Jammu and Kashmir Pollution Control Board through its secretary is impeded as party respondent and notice be issued for ensuring that all provisions concerning pollution laws are complied with," said the division bench.
The division bench directed Director Health Services Kashmir to submit a report with regard to health condition of the residents with how many cases of hepatitis B and C being reported from the area. The Director was also asked to collect information from hospitals like SKIMS and SMHS to find out magnitude of pollution spread by the establishments. "The Chief Irrigation and Flood Control Department shall file the status report with regard to the remaining structures in the form as has been furnished in respect of 465 structures. It is for the chief engineer to undertake mapping of the whole area from Pahalgam to Khanabal of Lidder area as per the direction already issued. He may also go for Google images of the area and place same on record," the court said.
