Court denies bail to lawyer in kidnapping and molestation case

Jammu, May 12 : Principal Sessions Judge Poonch today rejected the bail application of Anzar Ahmed (Advocate) who was arrested by the police in kidnapping and molestation case.
While hearing the case Principal Sessions Judge Poonch Jaffer Hussain Beigh rejected the bail application of Anzar Ahmed (Advocate) who was arrested by the police in kidnapping and molestation case. After hearing both sides including Public Prosecutor Choudhary Nazir Hussain, the Principal Sessions Judge Poonch Jaffer Hussain Beigh observed the accused has committed heinous offences, is a responsible and law knowing person advocate by profession, so he is not entitled for concession of bail.
Principal Sessions Judge Poonch Jaffer Hussain Beigh further observed that petitioner is not an illiterate person who doesn't know the pros and cons of the shameful act as per prosecution, the accused has committed. "With regard to the nature of evidence which is likely to come in the case is the prosecutrix and her family members, besides this witnesses and the petitioner's family having influence in the society as well as in the Bar as stated by Public Prosecutor that the Bar at Mendhar went on strike to favour the petitioner does not suggest that fair trial is possible if the petitioner is admitted to bail unless the statement of the prosecutrix who belongs to a very poor family is recorded, court said and with these observations Court rejected the bail application.
According to the police case that on March 23, this year at about 1:00pm the accused Anzar Ahmed while providing lift in his vehicle to the prosecutrix did not stop the vehicle when requested by the prosecutrix, forcibly took her, against her will towards Kawali Morh Forest where she raised alarm but despite that the accused did not let her free and forcibly compelled her to sit by using criminal force and in the meanwhile people after hearing her shrieks came on spot and rescued her.
Meanwhile the mother of the prosecutrix after found the prosecutrix missing had lodged the report before Police Station Mendhar where FIR was registered. And after completion of the investigation offences u/Ss 366, 354 RPC were established against the accused and the challan was presented before the court.(JNF)
