JAMMU, June 7: Crime Branch, Jammu today produced challan in case FIR No. 41/2013 u/s 409,201 RPC P/S Crime Branch, Jammu against Lal Chand, now SI retired before the Court of Chief Judicial Magistrate, Jammu. Facts of the instant case are that an enquiry was conducted at Crime Branch Jammu regarding misplacement of records from Malkhana Crime Branch Jammu comprising 13 files pertaining to "D" forms of Kashmiri Migrants which were obtained by the enquiry officer Lal Chand (now retired) from Zonal Officer Relief Zone Sangrampura, Jammu in Preliminary Verification and on whose recommendation a formal case was registered at P/S Crime Branch Jammu. It was found that the said record along with the PV file was handed over by S.I Mohammad Ishaq on his superannuation to Lal Chand the then in-charge Malkhana Crime Branch, Jammu under proper receipt duly attested by Dy. SP Crime Branch, Jammu. However, the said record was neither handed over by accused Lal Chand nor the same exists in the Record Room. From the aforementioned facts it spells out that accused Lal Chand (now retired) then posted in Crime Branch, Jammu being the enquiry officer obtained the record in question and recommended registration of a formal case into the matter. However, he intentionally and in-connivance with some other interested persons in case caused misplacement/destruction of the said records, entrusted to him being in- charge of Malkhana in order to confer undue benefits upon the accused persons. From the investigation conducted in instant case and relevant document collected, it has been fully established that accused Lal Chand had intentionally misplaced files along with "D" Forms with the purpose to provide undue benefits to the accused persons for extraneous considerations. |
