Court frames charges against two CRPF officials, remitted case back to CJM Jammu
Alleged death of CRPF man at PCR Jammu

Jammu, June 19 : Principal Sessions Judge Jammu RS Jain has framed charges u/s 304-A against Mohd Yasin and Mohan Lal Puri who was booked by the Police in alleged murder of one CRPF personal at Police control Room Jammu and remitted the case back to Chief Judicial Magistrate Jammu. According to the police case against accused persons , on 16.9.2013, a written complainant was filed by Coy commander B/160 Bn CRPC in police station Pacca Danga, Jammu to the effect that one CRPF personnel namely Akbar Ali on duty at the gate of PCR, Jammu was shot and injured by a 9 mm carbine of an unknown personnel of 14 IRP with intention to kill. On receipt of the written complaint, FIR No. 166/2013 was registered in police station Pacca Danga, Jammu for offence 307/34 RPC. During the investigation, two empty cartridges of 9 mm, one fire bolt, one carbine of Mohan Lal and 1 SLR along with ammunitions were seized. That deceased Akbar Ali on 16.9.2013 died at 9:04 AM. During the investigation, statements of witnesses recorded and it came out that Mohan Lal, Head Constable without lock and authorization gave his weapon carbine to accused Mohd Yasin who in the court yard of PCR, Jammu while fiddling with the carbine fired the weapon which hit lance-naik Akbar Ali. The constable knew that due to carelessness and negligence, a life could be lost. After the occurrence, Mohan Lal took his weapon from accused Mohd Yasin and in a negligent manner fired three rounds which could endanger human life. As per investigation, it came out that accused persons did not have any enmity with deceased and did not have any intention to murder. Hence accused being guilty, the present challan for offence u/s 304-Part-II/30 Arms Act against Mohd Yasin and for offence u/s 336 RPC/ 30 Arms Act against accused Mohan Lal. Principal Sessions Judge Jammu Mr. RS Jain after hearing Public Prosecutor for the state whereas Advocate Ashwani Khajuria appearing for the accused person observed that prima facie offence u/s 304-A RPC/30 Arms Act is made out against accused Mohd Yasin and offence u/s 336 RPC/30 Arms act is made out against accused Mohan Lal. Accordingly accused are charge sheeted for the said offences. As the offences for which the accused are charged not exclusively triable by the Court of Sessions and are triable by the Judicial Magistrate, the challan is remitted back to CJM, Jammu to proceed with the case in accordance with law either by himself or transfer the case to some other Court.
