| HC directs State not to divert Seven posts of Librarian from promotional quota | | | Early Times Report Jammu, June 19 : In a petition filed by Anjum Nisar Malik & Orr challenging that the Govt preferred to issue an advertisement whereby they resorted to direct recruitment without simultaneously referring the cases of the petitioners to the DPC/PSC and this shows the malafide intention of the respondents towards the petitioners who have been taken up for hostile discrimination for none of their fault, Justice Dhiraj Singh Thakur of J&K High Court Jammu Wing issued notice to the state and in the meanwhile directed State respondents that the seven posts of Librarian in the grade of 8000-13500 (Higher Education Dept) shall not be diverted from promotional quota as provided in SRO 423 of 2008. While staying the Seven posts of Librarian in Higher Education Dept, Justice Dhiraj Singh Thakur observed that the respondents cannot be allowed to play with the service career of the petitioners who are highly educated/ experienced and have rendered 11 to 18 years of service in the Higher Education Department in the non-Gazetted Cadre with the hope that they will jump into the Gazetted Cadre in the light of the Recruitment Rules of 2008. The Apex Court has time and again ruled that an employee gets stagnated in case there are no promotional avenues and it effects efficiency also and it is further held that an employee must get at least two to three promotions in his service career and on the other hand the petitioners are stagnating on the one post since their initial appointment despite being possessed of the higher degrees like B.Lib/M.Lib. The action of the respondents is malafide aimed to deprive the petitioners from their promotional avenues as such the indulgence of this Court is warranted. |
