| Denial of admission to children of trans-genders | | DB grants last opportunity to State | | Jammu, July 19: In a PIL filed by Mian Haji Saria seeking direction to the respondents to ensure compliance of Fundamental "Right to Education" in letter and spirit and also directed private educational institutions not to discriminate "Trans-Genders" in Education Institutions while treating them as aliens, Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Tashi Rabstan observed that on June 3, 2014 Division Bench had directed state to submit a comprehensive action plan with regard to the steps to be taken by the State of J&K in terms of Apex Court direction in this regard. The nine directions of the Supreme Court in which Supreme Court directed that Hijras, Eunuchs, apart from binary gender, be treated as "third gender" for the purpose of safeguarding their rights under Part III of our Constitution, and SC has directed the Centre and the State Governments to take steps to treat them as socially/ educationally backward citizens and extend all kinds of reservation in cases of admission in educational institutions and for public appointments. On this Sr. AAG Gagan Basotra sought some more time to comply with the order dated June 3, 2014 and requested for four weeks time. Upon this Division Bench granted one last opportunity of four weeks to file comprehensive action plan. |
