Srinagar, Aug 6: The Jammu and Kashmir High Court today issued notice to Director SKIMS on a petition by a female patient challenging refusal of transplant of kidney offered to her by a friend. According to her petition, she was taken ill in the year 2006 and was diagnosed as a case of CKD (Chronic Kidney disease) Grade- III, Hypertension under Registration (No. 834132) by the Department of Nephrology SKIMS Soura and was consequently advised kidney transplantation. She had identified the kidney donor outside her near relatives as such the doctors attending her referred the case of transplantation of kidney to the Authorization Committee constituted under the provisions of J&K Transplantation of Human Organ Act 1997. The Authorization Committee accordingly examined various donors including the relatives for prospective kidney transplantation recipients, a friend, on 17-6-2014 in the office chambers of Director SKIMS who is also the Chairman of authorization committee. However, to the bad luck of the patient, the authorization committee rejected her case allegedly on the ground of disparities in their statement. The patient consequently moved a representation to the authorization committee for reconsidering her case on compassionate grounds as her health conditions was deteriorating day by day. It was on July 7, 2014 that the authorization committee held its meeting and decided four cases of kidney transplantation, but rejected her case vide communication on 31-7-2014. After hearing the petition, a bench of Justice Ali Mohammad Magrey observed that the patient is presently maintained by process of Hemo-Dialysis and her improvement is only possible subject to transplantation. "In view of the nature of claim and urgency involved in the matter, it shall be appropriate to issue notice waived by M.I. Dar, counsel for SKIMS. He shall file objections, if any, tomorrow," the court said and posted the matter for final consideration on Thursday. |
