Ensuing session of LA last opportunity for Omar to enact new Land Acquisition Act

SRINAGAR, Aug 6: As the Law and Parliamentary Affairs Department is reported to have formulated a proposal for convening 10 days summer session of the State Legislature from 25th August , the Omar Abdullah lead Government has now last chance to bring a bill on new Land Acquisition act in Jammu & Kashmir assembly for which people of the state have been waiting very eagerly from the last many months . Pertinently the upcoming session would be the last session of state legislature under the present Government which is completing its term after a month or so. The new Land Acquisition Rehabilitation & Resettlement Act (LARR) has been enforced across all the states from January 1st 2014 . The law could not be extended to J&K state in view of the article 370 and the state Government also failed to enact a similar law in the state. The new land acquisition act was made operational through a Presidential assent . The Government failed to bring this bill in the budget session of State legislature which began from February 10th at Jammu early this year and ended on Feb 28th but that session of the legislature the bill wasn't introduced in the state legislature. Now Government has got a last chance to bring this bill which is going to benefit a large population. This law has a great importance especially in Jammu & Kashmir as thousands of acres of land has been acquired by Government at many places in the state. The Congress party which is part of the coalition Government in state is also mum over the issue inspite of the fact that the same party was enacted this law at national level .Under the new Land Acquisition Act property and land which is acquired in urban areas would be paid compensation double the market value of the said land / property etc and in rural areas where the property rates are comparatively less the compensation would be paid four times more than the extact market rate of the land / property . The new Land Acquisition law does not only guarantees high monetary compensation but it guarantees for Rehabilitation & Resettlement as well. The compensation under new Land Acquisition Act is to be paid retrospectively under this act (from 2011), but all is not going to be a reality in J&K in the absence of such a law in operation.
Land measuring thousands of kanals has already been acquired by the Government for six lanning of Jammu- Srinagar national highway and the work is under progress now , but the compensation being paid to the effected families amounts only to the market value of land and property. Similarly the land has been acquired by National Highway Authorities of India between Jammu and Udhampur and also by NHPC in Bandipora and Gurez for construction of a Hydro Electric Project and at many places the BEACON authorities too have acquired the land in Ganderbal and Kangan areas for road widening.
