Jammu, Oct 13 : A high court division bench of Justice Virender Singh and Justice Bansi Lal Bhat has upheld the acquittal judgment of Trial Court and acquitted Shabir Ahmed, dismissing the appeal filed by the state. According to the police case on 10.10.2010,when a Honda City car (PB08BJ/3553), which was on its way from Udhampur to Batote at an excessive speed, was intercepted by a patrol party at Kud, it had tried run over the cops and then sped away. According to prosecution version, the patrol party members had a providential escape. A case was then registered at Kud Police Station for offence under Section 307 of RPC. The bench, after hearing the two sides, observed that the sessions judge, on appreciation of evidence adduced by prosecution at trial, had arrived at the conclusion that while prosecution had established that the offending vehicle was being driven dangerously and at excessive speed disclosing commission of offence under provisions of Motor Vehicles Act and section 279 of RPC, complicity of the accused as the driver of offending vehicle had not been established beyond shadow of doubt. With these observations, the bench upheld the acquittal. (JNF) |
